Terms and Conditions of the batida.pl online store
Version effective from: 04.10.2026
These Terms and Conditions describe how the batida.pl online store works: how you place an order, how you collect or receive products, how you pay, what rights you have and how we can help if something goes wrong. We address you directly ("you") and refer to ourselves as "we" or "Batida". You can download, save and print these Terms and Conditions at any time.
Purchases for businesses (cafés, restaurants, hotels, offices) are made in the b2b.batida.pl store under the separate Terms and Conditions of the Store for Businesses (B2B).
§ 1. Who we are and how to contact us
- The batida.pl online store (hereinafter: the "Store") is run by Batida Group sp. z o.o. with its registered office in Warsaw, ul. Łowicka 58/13, 02-531 Warszawa, entered in the register of entrepreneurs of the National Court Register kept by the District Court for the Capital City of Warsaw in Warsaw, XIII Commercial Division of the National Court Register, under KRS number 0001238720, NIP 5214163469, REGON 544631950, share capital 5 000,00 zł (hereinafter: "Batida", "we").

- We make Food Products by hand in our Pracownia pastry kitchen at ul. Przy Lasku 2 in Warsaw.
§ 2. Definitions
- Customer, you - any person who uses the Store, in particular who places an order in it.
- Consumer - a natural person who concludes a contract with us for purposes not directly related to their business or professional activity.
- Sole Trader with Consumer Rights - a natural person running a business who concludes a contract with us that is related to that business but is not of a professional nature for them (Articles 7aa and 38a of the Consumer Rights Act). We also apply the provisions of the Terms and Conditions concerning Consumers to such a person.
- Product - a good or service offered in the Store. We distinguish:
- Food Products - cakes, tarts, individual desserts, pastries, baked goods, dishes and other products that deteriorate quickly or have a short shelf life,
- Personalised Products - Products made according to your instructions, e.g. a cake with an inscription, a letter, a cake from the "cake creator" (Custom Cakes), as well as Food Products prepared for a date chosen by you,
- Non-Food Products - candles, small plates, sets, T-shirts (merch) and similar accessories, as well as food products with a longer shelf life, e.g. syrups,
- Tasting - the "Wedding cake tasting" service described in § 17.
- Preparation Time - the minimum time we need to prepare a Product, stated on the Product page (e.g. 24 h, 48 h, 72 h). Products with a Preparation Time of 24 h can be ordered for the next day until 21:00 on the previous day. The cart shows only those dates that take it into account.
- Fulfilment Date - the day and time slot of collection or delivery that you choose in the cart.
- Pick-up Point - a Batida boutique or our Pracownia pastry kitchen, where you can collect your order. The current list of Pick-up Points with addresses and hours is in the Store (the cart and the Boutiques page).
- Own Delivery - delivery of the order by our refrigerated transport to an address in Warsaw or the Warsaw area.
- DPD Foods Shipping - shipping of selected Products by courier at a controlled temperature (DPD Polska) to selected cities in Poland.
- InPost Shipping - shipping of T-shirts and other designated Non-Food Products by InPost courier or to a Paczkomat parcel locker.
- Account - your customer account in the Store (§ 4).
- Closed Days - days on which we do not carry out collections, deliveries or shipments; always Sundays and the days indicated in the Store (the cart shows only available dates). Some boutiques may be open on those days, but we do not then hand over or deliver orders from the Store.
- Terms and Conditions - this document.
§ 3. Services provided electronically
- Through the Store we provide the following services electronically, free of charge:
- browsing the content of the Store (descriptions, photos, blog, lookbooks),
- the cart and placing orders (including the choice of collection or delivery, date and time),
- the Account (§ 4),
- the "My account" panel (§ 5), including the birthday gift and the "How well do you know Batida?" quiz (§ 6),
- the newsletter - if you sign up for it (§ 4),
- "Remind me in a year" - an e-mail reminder about an occasion, if you switch it on in the cart (§ 4),
- "Important dates" - annual e-mail reminders about dates saved in the "My account" panel (§ 4),
- order e-mails (e.g. order confirmation, information about collection or delivery) and - if you have consented to receiving commercial information - a request for a review after the order has been fulfilled (§ 23),
- contact forms (Contact, HoReCa, Corporate Catering, "Friday at the office", Custom Cakes, Careers), including the option to attach a file where the form provides for it,
- product reviews (§ 23),
- the loyalty programme (§ 24).
- The contract for the provision of the content browsing and cart service is concluded for the duration of your use of the Store and terminates when you leave the Store. Contracts for the Account, the "My account" panel, the newsletter, reminders and the loyalty programme are concluded for an indefinite period and you can terminate them at any time (§ 4 and § 5).
- Complaints concerning electronic services (e.g. a form that does not work, a login problem) can be submitted to sklep@batida.pl. We respond within 14 days.
- We may temporarily restrict access to the Store due to technical work. We try to do this at times of lowest traffic.
§ 4. Account, newsletter and reminders
- Account. You create an Account by providing your e-mail address. You log in with a one-time code sent to that address (you do not set a password). In your Account you can see your orders and details, and after logging in you can use the "My account" panel (§ 5). You can also shop without an Account. You can delete your Account at any time by writing to sklep@batida.pl; we may delete it if you breach the Terms and Conditions or the law, after first calling on you to stop the breaches.
- Newsletter. You sign up by providing your e-mail address and consenting to receive commercial information from us. You can unsubscribe from the newsletter at any time by clicking the link in the footer of the message or by writing to sklep@batida.pl.
- 10% welcome discount. After you sign up, we will send you, at the address provided, a personal 10% discount code for your first order in the Store, valid for 30 days from sending. We do not send the code if an order has already been placed in the Store with that e-mail address.
- The code works only for the first order placed with a given e-mail address and only once per person. It reduces the price of Products and does not cover the cost of delivery.
- The code cannot be combined with other discounts and codes, including the quiz code, the birthday gift (§ 6) and loyalty programme rewards. It does not cover business orders in the b2b.batida.pl store.
- Signing up again after unsubscribing from the newsletter does not entitle you to a new code. The code cannot be exchanged for cash.
- We may end the welcome discount or change its rules for the future by announcing this in the Store. Complaints are handled under the procedure in § 3(3).
- Marketing SMS messages. If you give separate consent to this (e.g. at checkout), we will send you SMS messages with information about new products and promotions via Shopify Messaging. This consent is voluntary and independent of consent to the e-mail newsletter. You can opt out of SMS messages at any time by replying STOP to any message or by writing to sklep@batida.pl. We do not charge for receiving SMS messages.
- Remind me in a year. In the cart you can ask us to remind you by e-mail of your occasion (e.g. a birthday) about a week before its anniversary and to show you what was in your order a year ago. The reminder is voluntary and one-off, and you can cancel it by writing to sklep@batida.pl or by switching it off in the "My account" panel (the "Important dates" tab).
- Important dates. In the "My account" panel (§ 5) you can save the dates of occasions that are important to you: the day and month, the occasion (e.g. a birthday, a wedding anniversary) and - if you wish - the name or description of the person the occasion concerns (e.g. "Mum"). About a week before each saved date we will send you one e-mail with a reminder and suggestions from our current range - every year until you delete the date. If you save a date later than a week before it, we will send the first reminder a year later. The reminder is a service you request by saving the date, which is why we send it even without your consent to the newsletter. You can delete a date at any time in the panel (the "Important dates" tab) or by writing to sklep@batida.pl; from that moment we do not send reminders. The number of dates you can save is limited - the panel shows the limit.
- When using the Account or other services, you undertake to provide true data and not to give others access to the e-mail inbox you use for logging in.
§ 5. The "My account" panel
- "My account" (hereinafter: the "Panel") is a service provided electronically, available at batida.pl/pages/moje-konto after logging in to your Account (§ 4(1)). Using the Panel is free of charge and requires an Account. Business accounts from the b2b.batida.pl store use the B2B Zone panel under the Terms and Conditions of the Store for Businesses (B2B).
- In the Panel you can in particular:
- Orders - see the history of orders placed in the Store and, using the "Order again" button, add to the cart those Products from a previous order that are available at that moment. You then place the order on the usual terms (§ 10), at the prices applicable at the time it is placed. The button does not add some items (e.g. a cake inscription, a letter, a candle, a Tasting) - you select them again.
- Next order - see the date, place and status of your next scheduled order. You cannot change the order in the Panel: you request a change of date or Pick-up Point by e-mail to sklep@batida.pl or by telephone, no later than as many hours before the Fulfilment Date as the Product's Preparation Time, and for Products with a Preparation Time of 24 h - by 21:00 on the previous day (§ 19(2)).
- Important dates - save dates and manage reminders (§ 4(5)), including those switched on in the cart ("Remind me in a year", § 4(4)).
- Invoices and addresses - save invoice details (NIP, company name, address; after you enter the NIP, the company details may be filled in from the Ministry of Finance's register of VAT taxpayers) and switch on the "Always add an invoice to my order" option. When the option is on, we tick "Company invoice" in the cart and enter the selected company; you can change this before placing the order. We issue the invoice to the details given in the order (§ 12(2)). In the same tab you can see your saved delivery addresses with the nearest boutique; you add and change addresses in your Account settings.
- Settings - check whether you have consented to the newsletter and sign up for it (§ 4(2)); you unsubscribe from the newsletter using the link in each message.
- Loyalty programme - see your points and level and go to exchanging points for rewards (§ 24).
- Birthday gift and quiz - enter your date of birth and take part in the "How well do you know Batida?" quiz, and in the "Your codes" section see the discount codes you have received and their validity (§ 6).
- Your café - see the boutique from which you most often collect orders (and if you do not yet have such orders - the boutique nearest to your address), with its opening hours and - if we publish it - the drinks menu.
- Your year with Batida - see a summary of your orders since the beginning of the year (e.g. number of orders, favourite Product, favourite day, most frequently chosen boutique) and download it as an image. The image is created in your browser - we do not save or publish it; you decide whether and where to share it.
- The range of Panel functions may change: we may add new functions and temporarily or permanently switch off additional functions (e.g. the quiz between editions). You can see the current range in the Panel. This does not affect orders already placed or codes already issued.
- You start using the Panel by logging in to your Account and opening "My account". You can stop using it at any time (just log out), delete the data saved in it (in the Panel or by writing to sklep@batida.pl) or delete your Account (§ 4(1)). When the Account is deleted, we also delete the data saved in the Panel; we keep order data in accordance with the Privacy Policy.
- To use the Panel you need the same as to use the Store (§ 7(1)). Complaints concerning the Panel are handled under the procedure in § 3(3).
§ 6. Birthday gift and the "How well do you know Batida?" quiz
- The birthday gift and the quiz are promotions available in the Panel (§ 5) for customers with an Account. Participation is voluntary and free of charge. They are not part of the loyalty programme (§ 24) and do not require joining it. They do not cover business accounts from the b2b.batida.pl store.
- Birthday gift.
- In the Panel you can enter the day and month of your birthday. On your birthday we will send you the "Sweetest wishes!" e-mail with a 10% discount code for one order in the Store.
- The gift is given only to people who, on their birthday, are subscribed to the newsletter, i.e. have active consent to receive commercial information from us (§ 4(2)). Without that consent we send neither the e-mail nor the code.
- The gift applies to birthdays falling on or after the day on which the date is saved in the Panel; there is no waiting period. We do not send a gift for birthdays that passed before the date was saved.
- The gift is given no more than once per calendar year, also after the date has been changed. You can change your date of birth once every 365 days.
- The gift code is valid for 7 days from your birthday - until 23:59 on the seventh day after your birthday (e.g. for a birthday on 12.10 - until 19.10 inclusive).
- The "How well do you know Batida?" quiz.
- After logging in to your Account you can complete a quiz in the Panel: 5 questions drawn from a pool of 10 questions, each with one correct answer. A selected answer cannot be changed. The quiz is available in those language versions of the Store for which we have prepared questions.
- For 4 or 5 correct answers you receive a 10% discount code for one subsequent order in the Store, valid for 30 days from completing the quiz (until 23:59 on the thirtieth day). With fewer than 4 correct answers no reward is given.
- The quiz can be completed once per Account in a given edition. A new edition, with new questions, may appear, e.g. together with a new seasonal menu - you can then take part again.
- Gift and quiz codes. Each code:
- is personal - assigned to your Account and works only in an order placed from that Account,
- is added automatically in the cart after you log in to your Account (you do not need to enter it); you can also see it in the Panel, in the "Your codes" section,
- is single-use - it covers one order,
- cannot be combined with other discounts and codes, including loyalty programme rewards or another gift or quiz code,
- reduces the price of Products and does not cover the cost of delivery,
- cannot be exchanged for cash or transferred to another person; if not used in time, it expires.
- In the event of abuse (e.g. the same person creating additional Accounts in order to complete the quiz again or receive another gift), we may cancel an unused code.
- We may end the birthday gift or the quiz or change their rules for the future by announcing this in the Store. This does not affect codes already issued.
- Complaints concerning the gift, the quiz and codes are handled under the procedure in § 3(3). We process your date of birth on the basis of your consent; details are in the Privacy Policy.
§ 7. Technical requirements and prohibition of unlawful content
- To use the Store, you need a device with internet access, an up-to-date web browser (e.g. Chrome, Safari, Firefox, Edge) with JavaScript and cookies enabled, and an active e-mail address. Payment may require your bank's app or a payment wallet (e.g. Apple Pay, Google Pay).
- You are prohibited from providing unlawful content, in particular in forms, reviews, blog comments, cake inscriptions and letters. In particular, you may not post content that is offensive, discriminatory or infringes the rights of others (including copyright and personal rights), advertising content or malicious software. You may also not disrupt the operation of the Store.
- Using the Store involves the typical risks found on the internet (e.g. malicious software, phishing). We recommend up-to-date software and caution towards messages impersonating Batida. We never ask for a password or card details by e-mail.
§ 8. Products and information about them
- On the page of each Food Product we state in particular: the name, description, ingredients and allergens, size or number of servings, Preparation Time, shelf life after collection or delivery (e.g. 48 h or 72 h) and storage instructions. We make this information available before the order is placed, in accordance with the regulations on the provision of food information to consumers.
- We make Food Products by hand and fresh for the chosen Fulfilment Date. They may differ slightly from the photos (colour, decoration, shape). The photos are for illustrative purposes only.
- In our Pracownia pastry kitchen we process gluten, eggs, milk, nuts, peanuts, soy, sesame, celery, mustard, fish and sulphites, so every Food Product may contain traces of them, even if they are not among its ingredients. We do not have a separate gluten-free area. If you have an allergy or intolerance, write to us before ordering.
- Food Products are intended for consumption within the stated time from collection or delivery and must be stored in accordance with the information on the Product page (usually in the refrigerator). You are responsible for storage after handover.
- Non-Food Products (e.g. T-shirts) have on their Product page the information required by product safety regulations, including the details of the manufacturer or responsible person and instructions for use and warnings, if needed.
- The information in the Store constitutes an invitation to conclude a contract and not an offer within the meaning of the Civil Code. You make the offer by placing an order (§ 10).
- We may introduce new Products, withdraw Products and run temporary promotions. This does not affect orders already accepted.
§ 9. Prices and promotions
- Prices in the Store are gross prices in Polish zloty (including VAT). They do not include the cost of delivery, which we show in the cart and in the order summary before the order is placed (§ 14).
- The price shown next to the Product at the time the order is placed is binding.
- When we reduce the price of a Product, next to the reduced price we state the lowest price of that Product in the 30 days before the reduction (Article 4(2) of the Act on Informing about the Prices of Goods and Services). For Products on sale for less than 30 days, we state the lowest price since the start of sales.
- Discount codes and loyalty programme rewards apply on the terms stated for the given promotion. Codes usually cannot be combined with one another, unless we have stated otherwise. The rules of the welcome discount for signing up to the newsletter are described in § 4(2), and those of the birthday gift and quiz - in § 6.
§ 10. Placing an order and conclusion of the contract
- We accept orders through the Store 7 days a week, 24 hours a day. We do not accept orders by telephone.
- To place an order:
- add Products to the cart (choose the variants; for a cake you can add "Cake inscription" - a separate item in the cart - and enter its text; for a letter, enter its text),
- in the cart choose the day and the fulfilment method: collection at a Pick-up Point or delivery (Own Delivery, DPD Foods Shipping or InPost Shipping - depending on the Products and the address), and then the time or time slot,
- if you wish, switch on additional options: "Someone else will pick up" or "This is a gift" (§ 18), "Remind me in a year" (§ 4), "I need a company invoice" (§ 12),
- enter your details in the cart (first name, surname, telephone, e-mail), accept the Terms and Conditions and confirm that you have read the Privacy Policy,
- go to checkout, complete or check your details and address, and check the summary (Products, prices, delivery cost, date),
- click the "Pay now" button (or an equivalent button indicating an order with an obligation to pay) and pay for the order.
- Until you click the order button you can freely correct the contents of the cart and the details provided.
- Placing an order is an offer to conclude a sales contract (or a Tasting contract). The contract is concluded when we send to your e-mail address the "Order confirmation" message with the order number. We send it after the payment has been booked. Until then we are not bound by your offer.
- The order confirmation contains a summary of the contract (Products, prices, delivery cost, fulfilment method and Fulfilment Date) and is recorded on a durable medium; please keep it.
- If the order is not paid for, no contract is concluded. We may send you a link to complete the payment.
- If, after the contract has been concluded, it turns out that we cannot fulfil the order for reasons beyond our control (e.g. lack of ingredients, a breakdown, force majeure, incorrect or incomplete address details preventing delivery), we will inform you without delay and offer a change of date, a replacement Product or a refund of the full amount paid. We make the refund no later than within 14 days.
- We follow notes entered in the "Order notes" field as far as possible. They do not form part of the contract unless we confirm them by e-mail. They do not change the Fulfilment Date or the place of collection or delivery chosen in the cart.
- The person placing the order must have full legal capacity.
§ 11. Payments
- You pay for the order in advance, online, at the Store checkout. We show the available payment methods at checkout. Currently these are: payment cards (including Visa and Mastercard), Shop Pay, Apple Pay and Google Pay (on devices that support them), BLIK and Klarna.
- Payments are handled by payment operators; their terms and conditions apply to the payment itself. We do not charge additional fees for choosing a payment method.
- There is no payment on collection or on delivery.
- If, after payment, the order still appears unpaid, write to sklep@batida.pl - we will check it with the operator.
§ 12. Receipts and invoices
- For each order we issue a fiscal receipt or an invoice.
- If you want a company invoice, switch on "Company invoice" in the cart and provide the company details with the NIP number before placing the order. We issue the company invoice automatically after the order has been paid for and send it to the National e-Invoicing System (KSeF), where it is available to your company in accordance with the regulations.
- A Consumer may request an invoice for a private individual by writing to sklep@batida.pl with the order number. We send the invoice by e-mail in electronic form, to which you consent by placing the order.
- If the order is a gift (§ 18), we do not put a receipt in the order. You have confirmation of the purchase with the price in the "Order confirmation" e-mail; if you need a receipt or an invoice, write to sklep@batida.pl, stating the order number.
§ 13. Personal collection
- Collection at a Pick-up Point is free of charge and there is no minimum order value.
- In the cart you choose the Pick-up Point from among the boutiques available for your order and date, as well as the day and time of collection. The list of Pick-up Points with addresses and opening hours is in the Store and may change; the list available in the cart at the time of ordering is binding.
- Our Pracownia pastry kitchen (ul. Przy Lasku 2, Warszawa) is solely a pick-up point for orders, open Monday to Saturday 8:30-13:00. There are no on-site sales there.
- When collecting, give the order number or the surname from the order. The order may be collected by another person who gives these details (§ 18).
- Check the order on collection. If something is not right, tell the boutique staff straight away - that is when it is easiest to put it right. This does not limit your rights under § 21.
- If you do not collect the order within the chosen time slot, we will keep it at the Pick-up Point until it closes on the day of collection. After the Pick-up Point closes, Food Products are disposed of and the price paid is not refunded, because the Product was prepared fresh for your date. If you know you will be late, call or write to us before the Pick-up Point closes - we will look for a solution.
§ 14. Delivery - methods, coverage and costs

- We check the postcode of the delivery address in the cart and at checkout. If the address is outside the coverage area, the cart will not offer delivery - you can choose personal collection or write to us; we deliver outside the coverage area only exceptionally, after individual agreement and pricing.
- Own Delivery. We deliver with our own refrigerated transport within the time slots you choose in the cart. From Monday to Friday you can also choose morning delivery in the 8:00-10:00 slot for a surcharge of 30,00 zł - we add the surcharge even when delivery is free. We do not deliver on Sundays or on Closed Days. Time slots may differ during holiday periods - the cart shows the current ones. The driver may call before delivery; please make sure the order can be received at the address given within the chosen slot (intercom, reception, a person to receive it).
- If delivery fails for reasons on your side (no one at the address, an incorrect address, no answer to the phone), the driver leaves the order at the Batida boutique at ul. Królewska 2 in Warsaw. You can collect it there until the boutique closes on the same day (boutique hours: Boutiques page). We do not make a second delivery. After the boutique closes, Food Products are disposed of and the price paid (including the cost of delivery) is not refunded, because the Product was prepared fresh for your date. In exceptional situations, write to us.
- When the Product is handed over to you or to a person indicated by you, responsibility for its storage passes to you. If you are a Consumer, the risk of accidental loss of or damage to the Product passes to you when the Product is handed over to you or to a person indicated by you other than the carrier.
§ 15. DPD Foods Shipping (other cities)
- Products marked in the Store as available for shipping (the "ships across Poland" category) can be sent by DPD Foods courier at a controlled temperature to the following cities and their surroundings: Katowice, Kraków, Łódź, Poznań, Toruń, Bydgoszcz, Inowrocław, the Tricity (Gdańsk, Gdynia, Sopot) and Wrocław. Availability is determined by the postcode checked in the cart.
- The cart shows the available dispatch days. We dispatch parcels from Tuesday to Friday (except on Closed Days), and the courier usually delivers them the next day, during the courier's working hours, with no option to choose a time.
- DPD informs you of dispatch and delivery (by SMS or e-mail, using the details in the order). We send the tracking number by e-mail.
- We may add Products that do not require refrigeration (e.g. candles, toppers) to the same parcel, if they are marked as available for shipping.
- Check the parcel on receipt. If it is damaged, draw up a damage report with the courier and take photos - this will make the complaint easier. Report a complaint about a damaged or incomplete shipment to us as soon as possible, preferably on the day of delivery, to sklep@batida.pl with photos. Reporting later does not deprive you of your rights under § 21, but given the nature of Food Products it may make it harder to establish the cause.
§ 16. T-shirts and other Non-Food Products - InPost Shipping
- We sell T-shirts (merch) at a price of 69,00 zł. They are shipped separately from Food Products, by InPost courier or to a Paczkomat, for 19,99 zł. Shipping is free when the value of the T-shirts in the order is at least 500,00 zł.
- In the cart you choose a Paczkomat on the InPost map (or enter its code) or provide an address for courier delivery.
- We are currently selling T-shirts on pre-order: we ship them from 20.10.2026. We state this date on the Product page and in the cart. If we are unable to meet it, we will inform you by e-mail; you can then withdraw from the contract with respect to that part and receive a refund.
- We send the tracking number by e-mail. Collect the parcel from the Paczkomat within the time specified by InPost (usually 48 h). An uncollected parcel is returned to us; we agree on re-shipment by e-mail.
- Other Non-Food Products (candles, small plates, sets, syrups) added to an order with Food Products are handed over together with them on collection or delivery.
§ 17. Wedding cake tasting
- "Wedding cake tasting" (150,00 zł) is a service: a meeting for 2 people at the Batida Giełdowa boutique (ul. Giełdowa 5, Warszawa), during which you taste 5 selected cake flavours and discuss the design of your wedding cake with us. The price includes drinks for 2 people; if more people come, drinks for them are charged extra. If, after the Tasting, you order a cake from us worth at least 1 000,00 zł, we will deduct 150,00 zł from its price.
- You buy the Tasting in the Store like a Product. The date in the cart is for technical purposes only. After the purchase, write to sklep@batida.pl or call us - together we will agree on the day and time. Please provide a contact telephone number.
- You can change the date free of charge no later than 48 hours before the agreed date, by writing to sklep@batida.pl or calling us.
- If you are a Consumer, you can withdraw from the Tasting contract within 14 days of purchase without giving a reason (§ 20). If you want the Tasting to take place before those 14 days have passed, we will ask you for your express consent to the performance of the service before the withdrawal period expires; once the service has been fully performed, the right of withdrawal expires (Article 38(1)(1) of the Consumer Rights Act).
- If you do not attend the agreed Tasting and do not change the date in accordance with section 3, the Tasting is forfeited and the amount paid is not refunded, because we have prepared samples for you for that day. In exceptional situations, write to us.
§ 18. Gift and collection by another person
- The order may be collected or received by a person other than you. In the cart you have two options:
- "Someone else will pick up" (for delivery: "The recipient is someone else") - you give that person's first name, surname and telephone number. For personal collection we will pass them on to the Pick-up Point staff, and for delivery - to the driver, solely in order to hand over the order to that person and to contact them if there are any questions;
- "This is a gift" - we will not include a receipt or a confirmation with prices in the order; we will send them only to you, by e-mail. You can state who the gift is for (first name and - if you wish - surname and telephone number); for personal collection we will pass these details on to the Pick-up Point staff.
- By providing the recipient's details, you confirm that you have the right to pass them on to us. Information about the processing of the recipient's data is in our Privacy Policy.
- We do not put a receipt in a gift (§ 12(4)). The price is not visible to the recipient unless you state it, e.g. in a letter.
- You decide on the text of the cake inscription or letter and are responsible for it. We may refuse to make an inscription or letter whose content is unlawful, offensive or contrary to accepted standards of decency; in that case we will contact you to change it, and if this is not possible - we will refund the money for that part of the order.
§ 19. Changes to the order and cancellation
- We prepare Food Products specially for your date, so changes are possible only to a limited extent.
- You can request a change of the date, of the place of collection or delivery, or of the contents of the order by e-mail to sklep@batida.pl or by telephone (number and hours - § 1(2)) no later than as many hours before the Fulfilment Date as the Preparation Time of the Product stated on its page (24, 48 or 72 hours; for several Products the longest Preparation Time counts). For Products with a Preparation Time of 24 h, this deadline expires at 21:00 on the day before the Fulfilment Date. This applies to all Products, including cakes from the cake creator - for them, the Preparation Time is the lead time stated in the quote. We confirm the change by e-mail; if the price changes, we settle the difference.
- Cancellation of the order (independently of the statutory right of withdrawal under § 20): you can cancel the whole order or part of it by writing to sklep@batida.pl within the deadline in section 2 (as many hours before the Fulfilment Date as the Product's Preparation Time, and for Products with a Preparation Time of 24 h by 21:00 on the previous day; this also applies to cakes from the cake creator). We then refund the full amount paid within 14 days. Cancellation is not possible later, because the Product is already in production, unless we agree otherwise.
- Changes and cancellation concerning T-shirts: without restriction until shipment; after shipment, § 20 applies.
§ 20. Withdrawal from a distance contract
- If you are a Consumer, you have the right to withdraw from a distance contract within 14 days without giving any reason (Article 27 of the Consumer Rights Act). The period runs from the day on which you or a person indicated by you (other than the carrier) takes possession of the Product, and for services - from the day the contract is concluded. It is enough to send your statement before the period expires.
- When the right of withdrawal does not apply. In accordance with Article 38(1) of the Consumer Rights Act, you cannot withdraw from a contract whose subject is:
- a Food Product - cakes, tarts, individual desserts, pastries, baked goods, dishes and other products that deteriorate quickly or have a short shelf life (point 4),
- a Personalised Product - made to your specifications or serving to meet your individual needs, e.g. a cake with an inscription, a letter, a cake from the cake creator, a product prepared for a chosen date (point 3),
- a Product supplied in a sealed package which cannot be returned after opening for health protection or hygiene reasons - e.g. an opened syrup, opened sweets in a tin (point 5),
- a service (Tasting) fully performed with your express prior consent, where we informed you that you would lose the right of withdrawal once it had been performed (point 1).
- What you can withdraw from. You have the right of withdrawal in particular for T-shirts, candles, small plates, sets, unopened syrups and other Non-Food Products, as well as for the Tasting before it has been performed.
- How to withdraw. Send an unequivocal statement: by e-mail to sklep@batida.pl or by post to the correspondence address in § 1(2). You can use the form in Annex No. 1, but you do not have to. We will confirm receipt of the statement by e-mail.
- Returning the Product. Send the Product back without delay, no later than 14 days from the day of withdrawal, to: Batida Group sp. z o.o., office, ul. Królewska 2, 00-065 Warszawa. You bear the direct cost of returning it. We do not accept cash-on-delivery shipments. You can also return the Product in person at a boutique.
- Refund. We refund all payments received from you, including the cost of the cheapest delivery of the Product offered by us, without delay, no later than 14 days from the day we receive the statement of withdrawal. We may withhold the refund until we receive the Product or proof that it has been sent back, whichever occurs first. We refund using the same payment method as used for the order, unless you agree to another one; you do not incur any costs as a result. If a more expensive delivery method than the cheapest one available in the Store was chosen in the order, we do not refund the difference.
- Condition of the Product. You are liable for any diminished value of the Product resulting from using it beyond what is necessary to establish its nature, characteristics and functioning (e.g. a T-shirt that has been worn or washed, or has no tags).
- The right of withdrawal on the above terms is also available to a Sole Trader with Consumer Rights.
- You can also find a summary of these rules on the Returns Policy page; the full rules are in these Terms and Conditions.
§ 21. Conformity of the Product with the contract and complaints
- We are obliged to deliver a Product that conforms with the contract. Towards Consumers (and Sole Traders with Consumer Rights) we are liable for any lack of conformity of the Product with the contract under the rules set out in Chapter 5a of the Consumer Rights Act (Articles 43a-43g). For other Customers, the provisions of the Civil Code on statutory warranty for defects apply.
- We are liable for any lack of conformity that exists at the time the Product is delivered and becomes apparent within two years from that time. For Food Products with a short shelf life, a lack of conformity by its nature becomes apparent during their shelf life - which is why we ask you to report it as soon as possible, preferably on the day of collection or delivery, with a photo. This makes it easier to establish the cause; reporting later does not deprive you of your rights.
- How to submit a complaint. Write to sklep@batida.pl (or by post to the correspondence address in § 1(2)) or submit a complaint at any Batida boutique. State: the order number, a description of the problem, the date you noticed it, what you expect (e.g. replacement, price reduction, refund) and - if you can - photos. If you are complaining about a Product that has not been eaten, keep it until we respond, if possible.
- Response. We respond to a complaint within 14 days of receiving it, by e-mail or on a durable medium. If we do not respond within this period, the complaint is deemed to have been accepted (Article 7a of the Consumer Rights Act).
- Your rights (Consumer). If the Product does not conform with the contract, you can demand that it be repaired or replaced; for Food Products, in practice this means preparing the Product again on an agreed date. If repair or replacement is impossible, would involve excessive costs, has not been carried out by us within a reasonable time, or the lack of conformity is significant, you can submit a statement on price reduction or withdraw from the contract. You cannot withdraw from the contract if the lack of conformity is insignificant. We refund the reduced price or the amount due after withdrawal without delay, no later than 14 days from receiving the statement (and in the case of withdrawal - from receiving the Product or proof that it has been sent back, if the Product is to be returned). We bear the costs of replacement, repair and collection of the Product.
- We make refunds using the same payment method, unless you agree to another one. We offer a voucher or discount code only with your consent - it does not replace a refund.
- We are not liable for non-conformity resulting from improper storage or transport of the Product after it has been handed over (e.g. a cake kept outside the refrigerator in hot weather), if information on storage was provided to you.
- Complaints concerning electronic services and the loyalty programme are handled under the same procedure.
§ 22. Out-of-court dispute resolution
- If a dispute cannot be resolved through the complaint procedure, a Consumer may use out-of-court methods of handling complaints and pursuing claims, in particular:
- apply to the Provincial Inspectorate of the Trade Inspection in Warsaw (ul. Sienkiewicza 3, 00-015 Warszawa, www.wiih.org.pl) with a request to initiate proceedings for the out-of-court resolution of a consumer dispute or for the case to be heard by the permanent arbitration court at the WIIH,
- use the free assistance of a municipal or district consumer ombudsman or a consumer organisation (e.g. the Consumer Federation),
- find more information on the website of the Office of Competition and Consumer Protection: polubowne.uokik.gov.pl and www.uokik.gov.pl.
- We consent to participating in proceedings for the out-of-court resolution of consumer disputes before the WIIH in Warsaw. If the dispute is not resolved after the complaint, we will provide you, on a durable medium, with information on whether we agree to such proceedings, together with the details of the competent entity.
- The European Online Dispute Resolution (ODR) platform was closed on 20 July 2025 and is no longer available.
- Using out-of-court methods is voluntary. You can also always bring the case before a common court.
§ 23. Product reviews
- In the Store you can add a review of a Product (rating, text, photo). Reviews are handled by the Judge.me tool.
- We accept reviews only from people who have bought the given Product in the Store. We check this by comparing the review author's e-mail address with orders in the Store (this is done by the Judge.me tool); published reviews are marked "verified purchase". We do not publish reviews for which we cannot confirm the purchase. After an order has been fulfilled, we may send you an e-mail asking for a review of the Products you bought - only with your consent to receive commercial information from us.
- We publish both positive and negative reviews. We do not publish reviews that breach § 7(2) (e.g. vulgar, promotional, not concerning the Product, containing personal data of third parties) or reviews that are evidently untrue or sponsored. We inform the author that a review has been rejected, if they have provided an e-mail address, together with a brief justification; you can appeal by writing to sklep@batida.pl.
- We do not buy reviews, do not pay for them and do not award loyalty programme points for them.
- By adding a review, you grant us a free, non-exclusive licence to publish it in the Store and in our materials (including on social media) together with the first name or pseudonym entered with the review.
§ 24. Loyalty programme
- We run a loyalty programme for Store customers. The rules for collecting points and rewards are set out in the separate Loyalty Programme Terms and Conditions.
- Participation in the programme is voluntary and free of charge.
§ 25. Personal data and cookies
- The controller of your personal data is Batida Group sp. z o.o. Detailed information about the purposes, legal bases, recipients, retention periods and your rights is in the Privacy Policy.
- The rules for the use of cookies and similar technologies and the way consent is managed are described in the Cookie Policy.
§ 26. Point of contact
- In accordance with the Digital Services Act (Regulation (EU) 2022/2065, Articles 11 and 12), our single point of contact for users of the Store, Member State authorities, the European Commission and the European Board for Digital Services is the e-mail address sklep@batida.pl. We communicate in Polish and English.
- We moderate user content (reviews, blog comments) according to the rules in § 7(2) and § 23. Notices of unlawful content are accepted at the same address.
§ 27. Intellectual property
- The content of the Store (texts, photos, graphics, logo, recipes, cake designs) is protected by copyright and belongs to Batida or is used under licence. You may use it within the scope of permitted personal use. Any other use requires our consent.
§ 28. Changes to the Terms and Conditions
- We may change the Terms and Conditions for important reasons: a change in the law or its interpretation, a change in payment, delivery or collection methods, the introduction or withdrawal of services, improved security, or the need to remove ambiguities.
- We announce future changes to the Terms and Conditions in the Store and - if you have an Account or subscribe to the newsletter - by e-mail, at least 14 days before the change comes into effect. If you do not accept the change, you can terminate the Account contract or another continuous service contract (§ 4 and § 5) free of charge until the day it comes into effect.
- Orders placed before the change comes into effect are governed by the Terms and Conditions as worded on the day the order was placed. We make previous versions of the Terms and Conditions available on request.
- This version of the Terms and Conditions applies from the date stated at its beginning and replaces the previous version. We apply it to orders placed from that day (for orders placed earlier - section 3). We inform Account holders of the new version by e-mail; if you do not accept it, you can delete your Account at any time free of charge (§ 4(1)).
§ 29. Final provisions
- We conclude contracts in Polish. The Store may also be available in other languages; in the event of discrepancies, the Polish version of the Terms and Conditions is binding.
- In matters not regulated herein, Polish law applies, in particular the Civil Code, the Act of 30 May 2014 on Consumer Rights, the Act of 18 July 2002 on the Provision of Electronic Services and the Act of 23 September 2016 on the Out-of-Court Resolution of Consumer Disputes. If you are a Consumer and live in another EU country, the choice of Polish law does not deprive you of the protection afforded to you by the mandatory provisions of the law of your country.
- No provision of the Terms and Conditions limits the rights you have under mandatory provisions of law. In the event of any conflict, the provisions of law prevail.
- The Terms and Conditions are available free of charge at batida.pl/pages/regulamin in a form that allows them to be downloaded, recorded and printed. We also send them in the order confirmation or as a link in that confirmation.
- Annex No. 1 (model withdrawal form) forms part of the Terms and Conditions.
