I. PERSONAL DATA PROTECTION

1. Batida Group sp. z o.o. attaches particular importance to the protection of personal data. The provisions of the Privacy Policy of Batida Group sp. z o.o. comply with the currently applicable personal data protection legislation, namely Regulation No. 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC, i.e. the so-called GDPR, as well as the Act of 10 May 2018 on the protection of personal data.

5. Personal data concerns natural persons.
   
   
6. Personal data will be processed by Batida Group sp. z o.o.:
   
   a) in the case of data collected for the purposes of fulfilling an order, pursuant to Article 6(1)(b) of the GDPR;
   b) in the case of data collected for marketing purposes, pursuant to Article 6(1)(a) of the GDPR;
   c) for the purpose of pursuing the controller’s legitimate interests—handling complaints and protecting against, determining and pursuing potential claims—pursuant to Article 6(1)(f) of the GDPR;
   d) for the purpose of pursuing the controller’s legitimate interests in the case of personal data obtained through an automated system that enables the collection of website users’ data, to monitor how users use the controller’s website and to tailor it to individual users in order to conduct direct marketing more effectively, pursuant to Article 6(1)(f) of the GDPR.

Batida Group sp. z o.o. will collect the following personal data for the fulfillment of an order: first and last name; details of the company where the natural person is employed or with which they cooperate, to the extent necessary to fulfill the order (NIP, company name, company address); email address; telephone numbers; and delivery address. In the case of personal data collected for marketing purposes, the following personal data will be collected: first and last name, email address and telephone number. In addition, Batida may also collect other data—IP address, browser data and location—which are processed automatically by systems operating on the website.
   
   
8. Batida Group sp. z o.o. declares that the personal data collected will be processed in accordance with applicable law, fairly and transparently, from the data subject.
   
   
9. If you have given consent in the Batida Group sp. z o.o. online form to the collection of data for marketing purposes, the personal data processed for this purpose will be used by Batida Group sp. z o.o. to maintain contact through regular and occasional communications by telephone, email, post and newsletter. You are not required to give such consent in order to use the services of Batida Group sp. z o.o. Regardless of the above, an automated system operates on the website that enables the collection of website users’ data and its processing for direct marketing purposes. Personal data collected and processed by Batida Group sp. z o.o. for the purposes indicated in this point will be stored in a form that enables identification of the data subject for an indefinite period, and in the event of a request to delete such data or an objection, until those requests are granted in accordance with the GDPR.

In the case of personal data collected for the purpose of placing and fulfilling a commercial order, and therefore for the purpose of performing the agreement related to the order placed, such personal data will be processed for the period necessary to fulfill the order and for the statutory period during which you may assert any claims against Batida Group sp. z o.o. and/or Batida Group sp. z o.o. may assert claims against you. Providing personal data for the purpose of placing and fulfilling a commercial order is a contractual requirement and a condition for concluding an agreement with Batida Group sp. z o.o.; if you do not provide the required data, the order cannot be accepted and fulfilled by Batida Group sp. z o.o.
    
    
11. Batida Group sp. z o.o. ensures the security and confidentiality of your personal data and guarantees the exercise of your rights in accordance with the applicable personal data protection regulations. By providing Batida Group sp. z o.o. with personal data, each person has the right to:
    
    a) request access from Batida Group sp. z o.o. to the personal data provided, including obtaining a copy of the data being processed, also in electronic form; rectification of such data if the data held by Batida Group sp. z o.o. are inaccurate or incomplete; erasure, for example if the data are no longer necessary for the purposes for which they were collected and Batida Group sp. z o.o. has no grounds for processing them, such as your consent or the performance of a legal obligation, or if the personal data are processed unlawfully; or to object to processing concerning the processing of your personal data within the framework of Batida Group sp. z o.o.’s legitimate interests, for reasons related to your particular situation. You also have the right to data portability with respect to the data you provided to us, in a machine-readable format, for example if you wish to provide them to another entity, and the right to restriction of processing in the following cases (when submitting a request, one of the following cases must be indicated):

• if you dispute the accuracy of your data—for a period enabling Batida Group sp. z o.o. to verify the accuracy of such data;
• if you believe that the processing is unlawful but do not want us to erase the data and instead request that we restrict their use;
• if we no longer need your personal data, but you need them in connection with the establishment, assertion or defense of your claims;
• if you have objected to the processing of your data and we are required to verify whether we should continue processing them, for the period necessary for that verification.
  
  b) withdraw consent at any time without affecting the lawfulness of processing carried out on the basis of consent before its withdrawal, where processing is based on the consent of the data subject;
  
  c) lodge a complaint with a supervisory authority (the President of the Personal Data Protection Office);
  
  
• You may exercise all of the above rights in accordance with Articles 15 to 21 of the GDPR.

12. You may exercise your rights by submitting an appropriate
    request at the registered office of Batida Group sp. z o.o. (ul. Łowicka 58 lok. 2, 02-531 Warsaw), by traditional or electronic mail, and, in the case of withdrawing consent, using the dedicated forms available on our websites.
    
    
13. Batida Group sp. z o.o. will inform you within one month of receiving your request about the actions taken in response to it. Where necessary, the period for responding to your request may be extended by a further two months due to the complex nature of the request or the number of requests submitted.
    
    
14. In order to fulfill your request, we are entitled to verify your identity so that your data do not fall into the hands of an unauthorized person.
    
    
15. If your request is manifestly unfounded or excessive, in particular because of its repetitive nature, Batida Group sp. z o.o. may charge a reasonable fee for processing the request or refuse to take action in response to it.
    
    
16. The above rights also apply if Batida Group sp. z o.o. plans to continue processing personal data for a purpose other than that for which the personal data were collected. In such a case, before carrying out such further processing, Batida Group sp. z o.o. will inform the data subject of that other purpose and provide all other relevant information concerning their rights.
    
    
17. For marketing activities, Batida Group sp. z o.o. uses profiling offered by social media platforms so that you receive commercial information from Batida tailored to your needs and preferences. Our website also uses an automated system that processes your personal data to better understand your needs and preferences. As a result, using our website will be more convenient for you and marketing content will be better tailored. However, such profiling never results in automated decisions that would affect your rights and obligations.

Batida Group sp. z o.o. undertakes to maintain the security and confidentiality of information concerning website visitors and not to use it in any publicly accessible database or for marketing purposes directed at third parties.

Batida Group sp. z o.o. processes personal data in a manner ensuring an appropriate level of security, including protection against unauthorized or unlawful processing and accidental loss, destruction or damage, using appropriate technical or organizational measures. The data subject is responsible for the security of their data, such as their email address, password, etc.

Cookies are used by the websites www.batida.pl and www.sklep.batida.pl to personalize content. Their purpose is to improve the operation of the website; we do not disclose information obtained using this technology to third parties. A user visiting the website may activate or deactivate cookies at any time, although this may limit the ability to use certain website functionalities.
