1. Batida Sp. z o.o. attaches particular importance to the protection of personal data. The provisions of the Privacy Policy of Batida Sp. z o.o. comply with the currently applicable personal data protection laws, i.e., Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC, known as GDPR, as well as the Act of 10 May 2018 on the protection of personal data.

6. Personal data will be processed by Batida Sp. z o.o.:
   
   a) in the case of data collected for the purpose of order fulfillment based on Art. 6(1)(b) GDPR;
   b) in the case of data collected for marketing purposes based on Art. 6(1)(a) GDPR;
   c) for the purpose of pursuing the legitimate interests of the controller – handling complaints and protecting against and establishing and pursuing possible claims based on Art. 6(1)(f) GDPR;
   d) for the purpose of pursuing the legitimate interests of the controller in the case of personal data obtained by an automatic system that allows collecting data of website users, to monitor how users use the controller’s website and to individually tailor to a given user in order to conduct direct marketing more effectively based on Art. 6(1)(f) GDPR.

Batida Sp. z o.o. will collect the following personal data for order fulfillment: first and last name, company data where the natural person is employed/with which they cooperate to the extent necessary for order fulfillment (NIP, company name, company address), e-mail address, phone numbers, and delivery address; for personal data collected for marketing purposes, the following personal data are collected: first and last name, e-mail address, phone number. Additionally, Batida may also collect other data – IP address, browser data, location – which are processed automatically by systems operating on the website.
   
   
8. Batida Sp. z o.o. declares that the collected personal data will be processed in accordance with applicable law, in a fair and transparent manner, from the person to whom the data relates.
   
   
9. If you have given consent in the Batida Sp. z o.o. online form to collect data for marketing purposes, the personal data processed for this purpose will be used by Batida Sp. z o.o. to maintain contact through regular and irregular communication via telephone communication, e-mail, postal mail, and newsletter. You are not obliged to give such consent to use Batida Sp. z o.o.’s services. Regardless of the above, an automatic system operates on the website that allows collecting user data and processing it for direct marketing purposes. Personal data collected and processed by Batida Sp. z o.o. for the purposes indicated in this point will be stored in a form enabling identification of the person to whom the data relates for an indefinite period, and in case of a request for deletion of these data or objection, until these requests are fulfilled in accordance with GDPR.

In the case of personal data collected for placing and fulfilling a commercial order, i.e., for the performance of a contract related to the placed order, such personal data will be processed for the period necessary to fulfill the order and for the period prescribed by law to allow you to submit any claims against Batida Sp. z o.o. and/or claims of Batida Sp. z o.o. against you. Providing personal data for placing and fulfilling a commercial order is a contractual requirement, a condition for concluding a contract with Batida Sp. z o.o.; if you do not provide the required data, the order cannot be accepted and fulfilled by Batida Sp. z o.o.
    
    
11. Batida Sp. z o.o. takes care to maintain the security and confidentiality of your personal data and to guarantee the exercise of your rights in accordance with applicable personal data protection regulations. By providing Batida Sp. z o.o. with personal data, each person has the right to:
    
    a) request from Batida Sp. z o.o. access to the provided personal data (including obtaining a copy of the processed data, also in electronic form); their rectification (if the data held by Batida Sp. z o.o. are inaccurate or incomplete), deletion (e.g., if the data are no longer necessary for the purposes for which they were collected, and Batida Sp. z o.o. has no grounds to process them, e.g., based on your consent or to fulfill a legal obligation, or if the personal data are processed unlawfully) or to object to processing (concerning the processing of your personal data within the legitimate interests of Batida Sp. z o.o., for reasons related to your particular situation); you also have the right to data portability of the data you have provided to us in a machine-readable format (allowing free reading by a computer), e.g., if you want to provide them to another entity, and the right to restrict processing in the following cases (when submitting a request, you should indicate one of the following cases):

• if you have objections regarding the accuracy of your data – for the period allowing Batida Sp. z o.o. to verify the accuracy of these data;
• if you believe that the processing is unlawful, but you do not want us to delete it, but instead request restriction of its use;
• if your personal data are no longer necessary to us, but you need them in connection with establishing, exercising, or defending your claims;
• if you have objected to the processing of your data, and it is our duty to verify whether we should continue processing them, for the time necessary for such verification.
  
  b) withdraw consent at any time without affecting the lawfulness of processing based on consent before its withdrawal, if processing is based on the consent of the data subject;
  
  c) lodge a complaint with the supervisory authority (President of the Personal Data Protection Office);
  
  
• All the above rights may be exercised in accordance with Articles 15 to 21 of the GDPR.

12. You may exercise your rights by submitting an appropriate
    request at the registered office of Batida Sp. z o.o. (ul. Szucha 8, 00-582 Warsaw), by traditional or electronic mail, and in the case of consent withdrawal, via special forms placed on our websites.
    
    
13. Batida Sp. z o.o. will provide you with information about actions taken in connection with your request within one month of receiving the request. If necessary, the deadline for fulfilling your request may be extended by another two months due to the complexity of the request or the number of requests received.
    
    
14. To fulfill your request, we are entitled to verify your identity to ensure your data does not reach an unauthorized person.
    
    
15. If your request is clearly unfounded or excessive, particularly due to its repetitive nature, Batida Sp. z o.o. may charge a reasonable fee for processing the request or refuse to take action in connection with the request.
    
    
16. The above rights also apply if Batida Sp. z o.o. plans to further process personal data for a purpose other than the one for which the personal data were collected. In such a case, before such further processing, Batida Sp. z o.o. informs the data subject about this other purpose and provides all other relevant information about their rights.
    
    
17. For marketing activities, Batida Sp. z o.o. uses profiling offered by social media platforms so that you receive commercial information from Batida tailored to your needs and preferences. An automatic system also operates on our website that processes your personal data to better understand your needs and preferences. This makes using our website more convenient for you and marketing content better matched. However, the result of such profiling is never the making of automated decisions that would affect your rights and obligations.

Cookies are used by the websites www.batida.pl and www.sklep.batida.pl to personalize content. Their role is to improve the website’s operation; we do not share information obtained using this technology with third parties.
