I. PROTECTION OF PERSONAL DATA

  1. Batida Sp. z o.o. pays special attention to the protection of personal data. The provisions of the Privacy Policy of Batida Sp. z o.o. are in accordance with the currently applicable laws in the field of personal data protection, i.e. with the Regulation of the European Parliament and of the Council No. 2016/679 of April 27, 2016 on the protection of individuals with regard to the processing of personal data and on the free flow of such data and repealing Directive 95/46/EC, i.e. the so-called RODO and the Act of May 10, 2018 on the protection of personal data.

  2. The administrator of the personal data is: Batida Sp. z o.o. with its registered office in Warsaw, Al. Szucha 8, 00-582 Warsaw, Poland, registered in the District Court for the Capital City of Warsaw in Warsaw, XII Economic Department of the National Court Register, KRS 0000167112, NIP (VAT) (PL) 526-021-30-08 and REGON 006921037.

  3. The personal data inspector appointed by Batida Sp. z o.o. can be contacted: 1) by post: to the address of Batida Sp. z o.o. indicated in section 2 of this Privacy Policy, 2) by e-mail: biuro@batida.pl or 3) by telephone at +48 22 621 45 34 or +48 22 621 53 15.

  4. Batida Sp. z o.o. also remains the recipient of the collected personal data, i.e. personal data will not be transferred to other entities. 

  5. Personal data refers to natural persons.

  6. Personal data will be processed by Batida Ltd:

    (a) in the case of data collected for the purpose of fulfilling an order on the basis of Article 6 (1) (b) of the RODO;
    b) in the case of data collected for marketing purposes on the basis of Article 6(1)(a) of the RODO;
    c) for the purpose of the administrator's legitimate interests - handling complaints and protecting against and establishing and asserting potential claims on the basis of Article 6(1)(f) RODO;
    d) for the purpose of realizing the administrator's legitimate interests in the case of personal data collected by an automated system that allows the collection of site users' data, in order to control how users use the administrator's site and to individually tailor to a given user in order to more effectively conduct direct marketing on the basis of Article 6(1)(f) RODO.

  7. Batida Sp. z o.o. will collect the following personal data for order processing: first and last name, data of the company in which the individual is employed/cooperates to the extent necessary for order processing (TIN, company name, company address), e-mail address and telephone numbers and delivery address, while in the case of personal data collected for marketing purposes, these are the following personal data: first and last name, e-mail address, telephone number. In addition, Batida may also collect other data - IP address, browser data, location - which are processed automatically by systems running on the site.

  8. Batida Sp. z o.o. declares that the collected personal data will be processed in accordance with applicable law, in a fair and transparent manner, from the data subject.

  9. If you have given your consent in the Batida Sp. z o.o. web form to the collection of data for marketing purposes, the personal data processed for this purpose will be used by Batida Sp. z o.o. for keeping in touch by means of regular and irregular communication through the use of telephone communication, by e-mail, by letter and by newsletter. You are not obliged to give such consent for the use of Batida Sp. z o.o. services. Notwithstanding the above, the site operates an automated system to collect data of site users and process it for direct marketing purposes. Personal data collected and processed by Batida Sp. z o.o. for the purposes indicated in this section will be stored in a form that allows the identification of the data subject for an indefinite period of time, and in the event of a request for deletion of such data or in the event of an objection, until such requests are granted in accordance with the RODO. 

  10. In the case of personal data collected for the purpose of placing and fulfilling a commercial order, and therefore for the purpose of performing the contract related to the order placed, these personal data will be processed for the period necessary for the fulfillment of the order and for the statutory period for the purpose of filing possible claims by you against Batida Ltd. and/or claims by Batida Ltd. against you. Providing personal data for the purpose of placing and processing a commercial order is a contractual requirement, a condition for entering into a contract with Batida Sp. z o.o. If you do not provide the required data, the order cannot be accepted and processed by Batida Sp. z o.o.

  11. Batida Sp. z o.o. is committed to maintaining the security and confidentiality of your personal data and guaranteeing the exercise of your rights, in accordance with applicable data protection laws. By providing Batida Sp. z o.o. with personal data, each person has the right to:

    (a) demand from Batida sp. z o.o. access to the personal data provided (including obtaining a copy of the data subject to processing, also in electronic form); rectification (if this data in the possession of Batida Sp. z o. o. is inaccurate or incomplete), deletion (e.g. if this data is no longer necessary for the purposes for which it was collected, and Batida Sp. z o.o. has no basis for processing them, e.g. on the basis of your consent or for the performance of a legal obligation, the personal data are processed unlawfully) or to object to processing (concerning the processing of your personal data within the legitimate interests of Batida Sp. z o.o, for reasons related to your particular situation); you also have the right to data portability of the data you provide to us in machine-readable format (allowing it to be read freely by a computer), e.g. if you would like to share it with another entity, and the right to restrict processing in the following cases (please indicate one of the following cases when making your request):
  • if you have objections to the accuracy of your data - for a period of time that allows Batida Ltd. to verify the accuracy of the data;
  • if you believe that the processing is unlawful, but at the same time you do not want us to delete the data, but request instead that we restrict its use;
  • if your personal data are no longer needed by us, but you need them in connection with the investigation, establishment or defense of your claims;
  • if you have objected to the processing of your data, and it is our duty to verify whether we should continue to process it, for the time needed for such verification.

    (b) revoke your consent at any time without affecting the lawfulness of the processing carried out on the basis of consent before revocation, if the processing is based on the data subject's consent;

    (c) file a complaint with the supervisory authority (President of the Office for Personal Data Protection);

  • You can exercise all the rights indicated above in accordance with Articles 15 through 21 of the RODO.

 

  1. You may exercise your rights by submitting the appropriate
    instruction at the registered office of Batida Sp. z o.o. (8 Szucha St., 00-582 Warsaw), via snail mail or e-mail, or, in the case of withdrawal of consent, via special forms on our websites.
  2. Batida Sp. z o.o. within one month of receipt of your instruction - will provide you with information about the actions taken in relation to your request. If necessary, the deadline for the implementation of your request may be extended for another two months due to the complexity of the request or the number of requests made.

  3. In order to fulfill your request, we are entitled to verify your identity so that your data does not reach an unauthorized person.

  4. If your request proves to be manifestly unreasonable or excessive, in particular due to its repetitive nature, Batida Ltd. may demand a reasonable fee for the execution of the request or refuse to act on the request.

  5. The above rights also apply if Batida Sp. z o.o. plans to further process personal data for a purpose other than the purpose for which the personal data were collected. In such case, before such further processing, Batida Sp. z o.o. shall inform the data subject of this other purpose and provide him/her with all other relevant information about his/her rights.

  6. In order to carry out marketing activities, Batida Sp. z o.o. uses profiling offered by social networks so that you receive commercial information from Batida tailored to your needs and preferences. Our site also operates an automated system that processes your personal data for better understanding of your needs and preferences. As a result, using our site will be more convenient for you and marketing content will be better tailored. However, the effect of such profiling is never to make automatic decisions that would affect your rights and obligations.

  7. Any personal data collected by Batida Ltd. will be obtained voluntarily and with the consent of the subject in order to provide the highest quality of service. Any consent will be given in a voluntary, specific, informed and unambiguous manner. Batida Sp. z o.o. undertakes to maintain the security and confidentiality of the information of website visitors and not to use it in any publicly available database or for marketing purposes to third parties.

  8. Batida Sp. z o.o. processes personal data in a manner that ensures adequate security of personal data, including protection against unauthorized or unlawful processing and accidental loss, destruction or damage by means of appropriate technical or organizational measures. The personal data subject is responsible for the security of his/her data, such as e-mail address, password, etc.

Cookies are small text files that are stored by your computer's browser on your computer's hard drive. The websites www.batida.pl and www.sklep.batida.pl owned by Batida Sp. z o.o. use cookie technology. Cookies are used by the websites www.batida.pl and www.sklep.batida.pl to personalize content. Their role is to improve the performance of the website, we do not share information obtained using this technology with third parties. A user visiting the website can always activate or deactivate cookies, which, however, may restrict the use of some website functionalities.
