BATIDA BRAND ONLINE STORE TERMS AND CONDITIONS

www.batida.pl 


I. GENERAL PROVISIONS

  1. The seller of the goods is: BATIDA GROUP sp. z o.o., with its registered office at ul. Łowicka 58 lok. 2, 02-531 Warsaw, entered in the register by the District Court for the capital city of Warsaw in Warsaw, 13th Commercial Division of the National Court Register (KRS): 0001238720, Tax Identification Number (NIP): 5214163469, National Business Registry Number (REGON): 544631950.
  1. At www.batida.pl BATIDA GROUP sp. z o.o. conducts business in the retail sale of confectionery, bakery, and delicatessen products by BATIDA GROUP sp. z o.o., intended for consumers and businesses.
  1. Contact with the Online Store Batida(www.batida.pl) is available via: 

from 10:00 to 17:00 (on business days) and from 10:00 to 17:00 on Saturdays and selected public holidays. 

  1. All prices of the goods presented are expressed in Polish zlotys and are gross prices (including VAT). The price shown next to the product at the time the Customer places the order is binding on the parties to the transaction. Prices do not include shipping costs.
  1. The information available on the website and subpages of the Online Store Batida do not constitute an offer within the meaning of the Civil Code. 

Prices indicate the remuneration at which the Seller may accept the order for processing order of the Customer. By placing an order using the mechanisms available on the website and subpages of the Online Store Batida (www.batida.pl) submits an offer to purchase a specific product on the terms set out in the Online Store’s terms and conditions Batida. 

  1. All products offered by the Online Store Batida (batida.pl) are fresh, free from physical and legal defects, and have been lawfully placed on the Polish market.
  1. For all goods sold by the Online Store Batida (batida.pl) Batida Group sp. z o.o. issues VAT invoices. If no invoice is issued, a fiscal receipt will be enclosed with the order.
  1. Through the Online Store Batida, the Seller provides the Customer with an electronic service consisting in ensuring that the Customer can browse the publicly available content of the Online Store Batida, consisting of textual, graphic, and audiovisual content.
  1. the Seller also provides the Customer with an electronic service consisting in enabling the Customer to conclude with the Seller a sales agreement for products described on the Online Store’s pages Batida.
  1. If the Customer decides to create an account in the Online Store Batida, the Seller also provides the Customer with an electronic service consisting in creating and maintaining an account in the Online Store Batida.
  1. The Seller informs the Buyer that the content available on the Online Store’s pages Batida constitute works within the meaning of the Act of 4 February 1994 on Copyright and Related Rights, to which the Seller holds the copyrights.

  2. The Seller informs the Customer that further dissemination of the content by the Buyer without the Seller’s consent, except for using the content as part of permitted personal use, constitutes an infringement of the copyrights held by the Seller and may result in civil or criminal liability.

DEFINITIONS 

The terms used in these Terms and Conditions mean: 

  1. Consumer – a natural person performing with an entrepreneur a legal act not directly related to their business or professional activity;
  2. Customer – a natural person, legal person, or organizational unit without legal personality but with legal capacity, using the online store (batida.pl) including, in particular, making purchases;
  3. Seller – BATIDA GROUP sp. z o.o., with its registered office at ul. Łowicka 58 lok. 2, 02-531 Warsaw, entered in the register by the District Court for the Capital City of Warsaw in Warsaw, 13th Commercial Division of the National Court Register under KRS no. 0001238720, NIP no. 5214163469, REGON no. 544631950. 
  4. Online Store Batida – online store Batida operated by the Seller at batida.pl; 
  5. Terms and Conditions – these terms and conditions for the provision of services by the Seller by electronic means within the Online Store Batida;
  6. Product – any item ordered from the Seller;
  7. Order – the Customer’s declaration of intent aimed directly at concluding Sales agreements specifying, in particular, the type and quantity of products.

 

III. PLACING ORDERS 

  1. The person placing the order also declares that they have full legal capacity to perform legal acts in accordance with the provisions of the Civil Code.
  1. Placing an order is tantamount to accepting these Terms and Conditions.
  1. The sale of products is carried out on the basis of orders placed via the Internet. Orders are accepted 7 days a week, 24 hours a day in the Online Store Batida via the website: batida.pl 
  1. The Customer may place an order:

-by registering and thereby creating an account in the Online Store Batida by visiting the website www.batida.pl(or) 

-by making a purchase without registering an account in the Batida Online Store by visiting the website www.batida.plwithout having to log in. 

  1. If the Customer decides to register, they provide their e-mail address and enter a password of their choice to secure access to the account they have created.
  1. To place an order, the Customer adds a product to the cart using the button on the product page: “Add to cart”, “To cart” / “Checkout”, “View cart” / “Your cart”. This indicates that the process of adding products to the cart has ended and that the Customer proceeds to the order summary. Clicking “Continue” constitutes acceptance of the order summary and proceeds to the personal and collection details.
  1. Acceptance of the cart takes place using the “Checkout” / “Continue” button, after which the Customer is redirected to the options for entering address details and selecting a delivery method.
  2. The next step is to choose the delivery method (personal collection or delivery to the specified address), the order collection date, and the payment method.
  1. Before placing the order, the Customer is asked to check the accuracy of the entire order, particularly the contact and address details, and to accept these terms and conditions and the privacy policy.
  1. The Customer then places the order (offer to purchase) using the “I buy and pay” button.
  1. The Customer is redirected to the Przelewy24 payment system to make the payment. 
  1. After the order is paid, an email confirming that the order has been placed is sent from sklep@batida.pl to the email address provided by the Customer in the order.
  1. If the order is not paid, an email is sent from sklep@batida.pl with a link to pay for the order through the payment system Przelewy24.
  1. The final and binding confirmation that the order has been placed and must be fulfilled is the return message from the Przelewy24 system confirming payment for the order.
  2. In the event of problems making a payment (e.g. if, despite making the bank transfer, the order still appears as unpaid, please contact us by email at: sklep@batida.pl. 

IV. ORDER FULFILLMENT AND DELIVERY 

    1. Submitting an order does not mean that it has been accepted for fulfillment.

    2. The Seller has the right to refuse to fulfill an order within 48 hours, for example due to the unavailability of a particular product or the inability to fulfill the order within the time specified by the Customer. In the case of paid orders, the Seller undertakes to refund the amount paid immediately after informedu The above provision does not apply to orders accepted for fulfillment, meaning those for which a sales contract has been concluded. 

    1. The Seller reserves the right not to fulfill an order in which the Customer has provided incomplete or false information, or has entered in the order comments information inconsistent with the order submitted on the online store platform, including, among other things: a different delivery date, a different delivery time or location, or other additional elements that may incur an additional charge. 

    1. Due to the short shelf life indicated in section 4 above and for the reasons specified in section VI 1. below, The Customer may withdraw from the contract and cancel the order before will be accepted for fulfillment. The Seller allows the cancellation of an order accepted for fulfillment only if the order is at a stage of processing that allows it to be withdrawn. It is usually 48 hours before the order is fulfilled.

    1. The standard order processing time is 24 to 48 hours from the time the funds are credited to the Seller’s account or the transaction is authorized in the case of electronic payments.

    1. The Client may collect the ordered goods in person from one of the sales outlets in Warsaw:

  • Batida Wola: ul. Przy Lasku 2, 01-424 Warsaw 
  • Batida Speciality, ul. Puławska 17, 02-515 Warsaw
  • Batida Speciality, Rakowiecka 43A, 02-521 Warsaw
  • Batida, Giełdowa 5, 01-211 Warsaw
  • Batida, Plac Vogla, ul. Zygmunta Vogla 62, 00-063 Warsaw 
  • Batida, Konstancin: Al. Wojska Polskiego 3 (Stara Papiernia Shopping Gallery), 05-520 Konstancin-Jeziorna 

    The Client may make changes to the order involving a change of delivery date, delivery address, or order contents no later than 48 hours before the scheduled fulfillment date, exclusively by sending instructions to: sklep@batida.pl

    The minimum order value for delivery is PLN 45 gross plus the delivery fee. The ordered goods may also be delivered to an address specified by the Client within Warsaw and selected neighboring municipalities. The Client covers the shipping cost. The delivery fee is divided as follows:

    • Cost:  PLN 50.00 – Warsaw districts: Śródmieście, Żoliborz, Wola, Targówek, Praga-Południe, Praga-Północ, Ochota, Mokotów,  Włochy,  Wilanów, Wesoła, Wawer, Ursynów, Ursus, Rembertów, Bielany, Białołęka, Bemowo
    • Cost:  PLN 50.00 – Municipalities neighboring Warsaw: Piaseczno, Konstancin-Jeziorna, Łomianki
    • Cost: PLN 75.00 – Municipalities neighboring Warsaw: Izabelin, Piastów, Ożarów Mazowiecki, Nadarzyn, Pruszków, Józefów, Marki, Jabłonna, Czosnów, Raszyn, Stare Babice (Babice Nowe), Izabelin
    • Cost: PLN 75.00 – Municipalities neighboring Warsaw: Wiązowna, Otwock, Kobyłka, Zielonka, Wieliszew, Izabelin, Legionowo, Halinów

     

    W the event of a request for delivery outside the standard delivery area, the service fee is determined individually and each time requires verification and approval by Batida. Batida reserves the right to refuse an order due to a delivery address that makes it impossible to deliver to the specified address within the designated time. 

     

    If the delivery is not collected despite the courier's attempts, the order will await collection until the end of the following day at the boutique at ul. Królewska 2 in Warsaw, from 10:00 to 19:00.

    1. Deliveries outside Warsaw are arranged by agreement expressed via email and submitted electronically to the following email address: sklep@batida.pl. Selected products may be delivered by Polish Post or an external courier. The cost of such delivery is determined individually each time and depends on the supplier's current price list, as well as the product's weight and size.
    1. The Seller will endeavor to fulfill the Client's comments entered in the “Comment” field where possible; they must not be regarded as services guaranteed by the Seller and do not condition the fulfillment of the basic order placed by the Client.
    1. If the Customer orders a cake with a dedication or a dedication plaque, BATIDA GROUP sp sp. z o.o. bears no liability whatsoever for the content contained therein. In particular cases, BATIDA GROUP sp. z o may refuse, without giving a reason, to fulfill an order containing a dedication due to its content, of which the Customer will be informed immediately. 
    1. Standard products feature the manufacturer’s logos, graphic elements, and other decorative elements that may not be visible in the sample photos. The colors shown in the photos may differ in reality from printed materials or their appearance on a computer monitor. Please carefully ensure that every product element meets your expectations—you can obtain product information by telephone at: +48 692 409 395 or by email at: sklep@batida.pl.
    1. PAYMENT TERMS

    Payment for purchases may be made in the following form: 

    -Credit card 

    -Debit card 

    -Electronic bank transfer

    -Klarna

    1. Electronic transactions are processed through the payment system Przelewy24. Only orders confirmed by Przelewy24 as paid or once the payment has been credited to the bank account of BATIDA GROUP sp. z o.o.

    V. DPD FOODS DELIVERY

    1. Delivery time
      a) Orders are delivered within 3 business days of placing the order.
      b) Orders are not processed on Mondays, weekends, and public holidays.

    2. Delivery conditions
      a) The cold chain is monitored to ensure product freshness.
      b) The shipment may contain goods that do not require controlled temperature.
      c) Goods must be resistant to damage caused by increased humidity and/or low temperatures in refrigerated compartments.

    3. Safety
      a) Delivery is certified in accordance with ATP and has the required permits from the Sanitary Inspectorate.
      b) The sender receives an SMS and email notification about the incoming shipment.
      c) The courier’s telephone number is provided in the SMS or email message.

    4. Delivery availability
      a) Delivery availability depends on the recipient’s postal code—the system automatically matches delivery availability based on the code entered.

    5. Delivery hours
      a) DPD Foods delivers shipments during business hours throughout the day.
      b) It is not possible to choose a specific delivery time.

    6. Delivery costs
      a) The shipping cost outside Warsaw is PLN 30 gross.

    7. Complaints
      a) If you receive damaged goods, you must file a complaint within 24 hours of receiving the shipment.
      b) The complaint notification should include a photo confirming the damage and should be sent to the following email address: sklep@batida.pl.
      c) The complaint will be рассмотрed within 3 business daysd) A refund for an accepted complaint will be issued within 21 business days.

    VI. RETURNS AND COMPLAINTS 

    Withdrawal from the sales agreement. 

    1. The Seller informs the Customer that, in accordance with the applicable regulations, a consumer may withdraw from the agreement without stating a reason by submitting an appropriate written statement within 14 days from the date of delivery of the goods, except in the following cases described in Article 38 of the Act of 30 May 2014 on Consumer Rights: The right to withdraw from an agreement concluded outside the business premises or at a distance does not apply to consumers in respect of agreements: point 3) concerning goods that are non-prefabricated, manufactured according to the consumer’s specifications or serving to meet the consumer’s individual needs; point 4) concerning goods that are liable to deteriorate rapidly or have a short shelf life; point 5) concerning goods supplied in sealed packaging which cannot be returned after opening due to health protection or hygiene reasons.
    1. Accordingly, a Customer placing an order via batida.pldoes not have the right to withdraw from the concluded agreement due to the products offered in the Batida Online Store being liable to spoil quickly, except for the exception indicated in point IV 5 above.
    1. The Seller does not accept any shipments or returned goods sent cash on delivery or with payment due upon delivery.
    1. In exceptional and justified cases, it is possible to cancel the order, provided that it has not yet been produced after the deduction.
    1. The order should be checked by the Customer and the sales outlet employee / driver / courier company employee. For this purpose, the ordered product / products should be inspected and presented, and checked against the goods receipt and release report.
    2. The Seller shall not be liable for errors when placing orders caused by congestion in the systems of payment platforms and banks. However, disputes arising from the above will be handled amicably by the Seller, with the aim of ensuring the Customer’s satisfaction. 

    VII. COMPLAINTS 

    1. Before collecting the order, the Customer is required to inspect it at the point of sale in the presence of an employee of the point of sale or the delivery person (driver / courier company employee).
    2. If the product is found not to conform to the contract after receipt or delivery, the Customer may file a complaint at any point of sale by providing the product and proof of purchase. Accordingly, the Customer may refuse to accept the goods.
    3. Complaint will be reviewed by the Seller if it was submitted immediately after the non-conformity of the goods with the contract was identified. 
    4. The complaint will be reviewed within 14 days from the date it was submitted by the Customer. BATIDA will inform the Customer by email or telephone of how the complaint was resolved.
    5. In the event of a complaint being accepted, the refund will be made in the form of:

    -a refund through the Przelwy24 within 21 business days (or) 

    -a refund by bank transfer to the Customer’s account (in the case of payment by electronic transfer) within 21 business days; (or) 

    -voucher for products from the Online Store Batida. Each complaint is considered individually. 

    1. Any disputes arising from the above points will be resolved amicably by the Seller, with the aim of satisfying the Customer. 

    VIII. PRODUCT DEFECTS 

    1. The Seller undertakes to deliver a product free from defects to the Customer.
    1. If the Customer discovers a defect, they may submit a statement requesting a price reduction or withdrawal from the contract, unless the Seller immediately and without excessive inconvenience to the Customer replaces the defective item with one free fromdefects or remedy the defect. This limitation does not apply if the Product has already been replaced or repaired by the Seller, or if the Seller has failed to fulfill the obligation to replace the item with one free from defects or to remedy the defect.
    1. If the Customer is a Consumer, they may:
    • request that the item be replaced with one free from defects instead of the defect remedy proposed by the Seller (or)
    • request that the defect be remedied instead of having the item replaced, unless bringing the item into conformity with the contract in the manner chosen by the Consumer is impossible or would require excessive costs compared with the method proposed by the Seller.
    1. When assessing whether costs are excessive, the value of the item free from defects, the type and significance of the identified defect, and the inconvenience to which the Consumer would be exposed by another method of remedy are taken into account. 
    1. The reduced price should remain in the same proportion to the price arising from the contract as the value of the defective item bears to the value of the item without the defect.
    2. The Customer may not withdraw from the contract if the defect is minor. 

    AMICABLE DISPUTE RESOLUTION 

    1. The Seller agrees to amicable resolution of any potential consumer disputes.
    1. The Consumer may use out-of-court methods of handling complaints and pursuing claims. In particular, the Consumer may:

    1) applying to a permanent amicable consumer court to resolve a dispute arising from the concluded sales contract, 

    2) contacting the provincial Trade Inspection inspector with an application to initiate mediation proceedings concerning the amicable resolution of the dispute between the Buyer and the Seller, 

    3) seeking assistance from a district (municipal) consumer ombudsman or a social organization whose statutory objectives include consumer protection. 

     

    1. The Consumer may find more detailed information on out-of-court methods of handling complaints and pursuing claims on the website https://polubowne.uokik.gov.pl.
    1. The Consumer may also use the ODR platform, available at http://ec.europa.eu/consumers/odr. The platform is used to resolve disputes between consumers and businesses seeking an out-of-court resolution of disputes concerning contractual obligations arising from an online sales contract or a contract for the provision of services.

     

    1. The Seller designates the following entity as authorized to resolve the dispute out of court: the Provincial Trade Inspection Inspectorate in Warsaw, ul. Sienkiewicza 3, 00-015 Warsaw, email address: ih_warszawa@wiih.org.pl. More information concerning the above-mentioned entity: http://www.wiih.org.pl/.
    1. Out-of-court resolution of consumer disputes shall consist in:
    • enabling the parties to bring their positions closer together in order to resolve the dispute between them;
    • presenting the parties with a proposal for resolving the dispute;
    • resolving the dispute and imposing its resolution on the parties.
    1. If, following a complaint submitted by the Consumer, the dispute has not been resolved, the Seller shall provide the Consumer, on paper or another durable medium, with a statement on:
    • intention to submit an application to initiate proceedings for the out-of-court resolution of consumer disputes or consent to participate in such proceedings (or)
    • refusal to participate in proceedings for the out-of-court resolution of consumer disputes.

     

    PERSONAL DATA 

    1. Pursuant to with the current the applicable legal provisions on the protection of personal data, i.e. Regulation No. 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC, i.e. the so-called GDPR, and the Act of 10 May 2018 on the protection of personal data. 
    1. We hereby inform you that the controller of our Customers’ personal data is BATIDA GROUP sp. z o.o., with its registered office at ul. Łowicka 58 lok. 2 in Warsaw, registered with the District Court for the Capital City of Warsaw in Warsaw, 13th Commercial Division of the National Court Register, KRS 0001238720, NIP (VAT) (PL) 521-416-34-69 and REGON 544631950.
    1. The entrusted personal data are used solely for the purpose of performing the agreement and, if the Customer consents by checking the appropriate box when placing an order, to provide information about new products and promotions offered by BATIDA GROUP sp. z o.o., as well as to pursue the controller's legitimate interests.
    1. In connection with its business activities and the personal data collected from the Customer, the Seller acts in accordance with its adopted Privacy Policy, available at www.batida.pl.
      You will find there all the information required by the GDPR concerning the processing of personal data by the Seller.
    1. The Seller, while operating the Online Store, Batida uses so-called files policy, in accordance with the provisions of the Privacy Cookies available on www.batida.pl
    1. The Seller does not is liable for damage caused by the Customer making passwords, access details to the specified email account, logins, and other non-public data provided for the purpose of fulfilling the order available to third parties, or if a third party obtained such data unlawfully (theft of personal data, hacking into ICT systems, hacking into the email account). 

     

    FINAL PROVISIONS 

    1. The Terms and Conditions set out the rules for purchasing in the Online Store Batida. Placing an order is equivalent to accepting all provisions and information contained in the Terms and Conditions.
    2. Matters not regulated by these Terms and Conditions shall be governed by Polish law:
    • the Act of 23 April 1964 – Civil Code; 
    • the Act of 16 February 2007 on competition and consumer protection; 
    • the Act of 23 September 2016 on the out-of-court resolution of consumer disputes, as well as other legal acts referred to in these Terms and Conditions. 
    1. The provisions of these Terms and Conditions may be amended by the Seller at any time. The aforementioned amendments will be published on the website batida.pl, and therefore the current version can be viewed and printed at any time.
    1. Sales agreements concluded before the amendment to the Terms and Conditions shall be governed by the Terms and Conditions in force on the date the agreement was concluded.
    1. A Customer who has a user account in the Online Store Batida, will be informed of any amendment to the Terms and Conditions at the email address assigned to the user's account. If the amended Terms and Conditions are not accepted, the Buyer may terminate the agreement for maintaining the user account with immediate effect (delete the user account) without incurring any costs.
    1. For using the Online Store Batida the Customer's ICT system should meet the following minimum technical requirements: 
    • Web browser: Microsoft Edge; Mozilla Firefox; Opera; Chrome; Safari. 
    • The User should have JavaScript enabled in their browser. 
    1. From the Online Store Batida(not) available for anonymous use. 
    1. The Seller reserves the right to introduce temporary promotions and withdraw products from the Online Store Batida.
    1. The Customer, when using the Online Store Batida may not provide unlawful content. The Customer is required to use the Online Store Batida in a manner compliant with the law, good morals, and the Terms and Conditions. In particular, the following are prohibited: 
    • sending via the forms available in the Online Store Batida unlawful content, in particular content that is offensive, racist, discriminatory, incites aggression or hatred, sexist, pornographic, 
    • using the Online Store Batida to conduct marketing activities, in particular publishing advertising, marketing, promotional, or sales-oriented comments in the Store, 
    • publishing in the Online Store Batida content that infringes the personal rights or intellectual property rights of others, in particular copyright, 
    • using the Online Store Batida in a manner that is burdensome to other users or the Seller, 
    • taking any action intended to disrupt the proper functioning of the Online Store Batida, in particular by using malware, 
    • using content available in the Online Store Batida in excess of the limits of permitted personal use, in particular distributing such content outside the Online Store Batida, 
    • sharing account access credentials with other people.

SMS marketing during the checkout process and initiating a transaction or subscription using our subscription tools, you agree to receive recurring text notifications (regarding your order, including abandoned cart reminders), marketing offers, and transactional messages, including requests for reviews from us, even if your mobile phone number is registered on any state or national do-not-call list.

    Message frequency may vary. Consent is not a condition of purchase. If you wish to opt out of receiving marketing messages and text notifications, reply STOP to any text message we send or use the unsubscribe link provided in any of our messages.

    You understand and agree that alternative methods of opting out, such as using other words or phrases, will not be considered valid means of opting out. We do not charge for the service; however, you are responsible for any fees and charges related to text messaging imposed by your wireless service provider. Message and data rates may apply.

    We reserve the right to modify any telephone number or short code we use to operate the service at any time. You will be notified in such cases.

    You agree that any messages sent to a telephone number or short code that we have changed, including any STOP or HELP requests, may not be received, and we will not be liable for fulfilling the requests contained in such messages.

    To the extent permitted by applicable law, you agree that we will not be liable for unsuccessful, delayed, or misdirected delivery of any information sent through the service, errors in such information, and/or any actions you may or may not take based on such information or the service.

    BATIDA BRAND LOYALTY PROGRAM REGULATIONS

     

    I. GENERAL PROVISIONS

    1.    The organizer of the loyalty program, hereinafter referred to as the “Loyalty Program” or, interchangeably, as the “Program”, is: BATIDA GROUP sp. z o.o., with its registered office at ul. Łowicka 58 lok. 2, 02-531 Warsaw, entered in the register by the District Court for the Capital City of Warsaw in Warsaw, 13th Commercial Division of the National Court Register under KRS number: 0001238720, NIP: 5214163469, REGON: 544631950.

    2.    At www.batida.pl BATIDA GROUP sp. z o.o. conducts business in the retail sale of confectionery, bakery, and delicatessen products by BATIDA GROUP sp. z o.o., intended for consumers and businesses.

    3.    Contact with the Batida Online Store(www.batida.pl) regarding arrangements for the Program is possible via:

    4.    All prices of the products displayed are expressed in Polish zloty and are gross prices (including VAT). The price shown next to the product at the time the Customer places the order is binding on the parties to the transaction. Prices do not include shipping costs.

    5.    The information provided on the website and subpages of the Batida Online Store does not constitute an offer within the meaning of the Civil Code.

    Prices indicate the remuneration for which the Seller may accept the Customer’s order for processing. By placing an order using the mechanisms available on the website and subpages of the Batida Online Store (www.batida.pl) submits an offer to purchase a specific product under the terms set out in the Batida Online Store regulations.

     

    II. DEFINITIONS

         Terms and Conditions – these terms and conditions governing the provision of services electronically by the Seller within the Batida Online Store

         Participant – an adult natural person with full legal capacity who has registered for the Loyalty Program in accordance with the rules described in the Terms and Conditions and has accepted the Terms and Conditions

         Account – the Participant’s individual account, created through the Participant’s registration in the Program and necessary to participate in the Program.

         Batida Online Store – the Batida online store operated by the Seller at batida.pl

         Seller – BATIDA GROUP sp. z o.o., with its registered office at ul. Łowicka 58 lok. 2, 02-531 Warsaw, entered in the register maintained by the District Court for the Capital City of Warsaw in Warsaw, 13th Commercial Division of the National Court Register under KRS: 0001238720, NIP: 5214163469, REGON: 544631950

         Order – a declaration of intent made by the Customer, directly aimed at concluding a sales agreement, specifying in particular the type and quantity of products.

         Points – units awarded to Participants in exchange for a specified amount spent by the Participant in the Batida Online Store on purchasing products and services from Sellers, or in exchange for performing specified activities, accrued during the Program period via the Batida Store website or through other participation, under the terms described in these Terms and Conditions, entitling Participants to receive a Reward

         Reward – a reward due to the Participant for earning the number of Points required to redeem it, in accordance with the provisions of the Terms and Conditions.

         Reward Collection Point – a designated option provided by the Seller via the Batida Online Store, where the Participant may collect Rewards or use Discounts by placing an order in the Batida Online Store

         Participation levels – levels of titles established to define the Participant’s loyalty status and access to additional privileges

     

    III. REGISTRATION FOR PARTICIPATION IN THE PROGRAM

     

    Participation in the Program is voluntary. To participate in the Program, you must register an Account. To create an Account, the Participant must have their own email address. The Participant is required to provide truthful information during the registration process, subject to the consequences set out in § 3 section 7.

    The Participant may have only one Account in the Application, regardless of the number of mobile devices and email addresses they have. If any irregularities are detected, the Participant’s Account may be blocked and the accumulated points deleted.

    The Participant’s account is linked to their email address, regardless of the registration and login method they choose.

    IV. REWARDS AND AWARDING OF POINTS

    1.    Points are awarded automatically once the conditions for the relevant activity have been met. In the case of activities requiring verification and/or system failures (e.g. sharing a post), the Participant may be asked to send proof that the task was completed to sklep@batida.pl.

    2.    Rules for Exchanging Points for Rewards Collected points may be exchanged for attractive rewards and discounts in the Batida Online Store. Rewards are awarded according to the following scheme:

         PLN 55 discount on purchases – 100 points

         PLN 25 discount on purchases – 50 points

    After collecting the required number of points, the Participant may redeem a discount when placing an order in the Batida Online Store. To do so, log in to your account and place an order online in accordance with the operating rules of the Batida Online Store described in the terms and conditions at https://batida.pl/

    3.    Rules for Awarding Points Participants in the Batida Loyalty Program can earn loyalty points for activities related to the Batida brand. Points are awarded according to the following rules:

         Following Batida on TikTok – 5 points

         Following Batida on Instagram – 5 points

         Sharing a Batida post on Facebook – 10 points

         Batida newsletter subscription – 5 points

         Birthday bonus – 5 points

         Posting a review – 1 point

         Account registration – 3 points

         Order placed – 1 point for every PLN 10 spent

         Program Referral Rewards Participants in the Batida Loyalty Program can earn additional points by recommending the program to their friends:

         The new user (the person invited by the Participant) receives a 15% discount on their first purchase after registering for the Program.

         The Participant who made the referral receives 10 points for each new user who makes their first purchase.

    Referral points are awarded automatically once the new user’s first order has been completed.

    4.    Participation levels The Batida Loyalty Program comprises four levels+

     participation levels, which determine the Participant’s loyalty status and access to additional benefits:

         Silver – awarded automatically upon account registration.

         Gold – achieved after earning 200 points | points multiplier x1.2

         Platinum – achieved after earning 1000 points | points multiplier x1.3

         Diamond – the highest level, available after earning 2000 points | points multiplier x1.5

    5.    Redeeming rewards Rewards can only be redeemed via the Batida Online Store. Discounts are applied automatically when placing an order after the required number of points has been reached.
    Rewards cannot be exchanged for cash or other equivalents. Points collected under the Loyalty Program do not expire. They remain active in the Participant’s account indefinitely.

    V. COMPLAINTS

    Any comments or complaints concerning the Program should be submitted by email to: sklep@batida.pl. Complaints are reviewed promptly, no later than within 14 days of the date of receipt.

    VI. PERSONAL DATA PROTECTION AND PRIVACY POLICY

    The controller of personal data processed in connection with the Program is: BATIDA GROUP sp. z o.o., with its registered office at ul. Łowicka 58 lok. 2, 02-531 Warsaw, entered in the register by the District Court for the Capital City of Warsaw in Warsaw, 13th Commercial Division of the National Court Register (KRS): 0001238720, NIP: 5214163469, REGON: 544631950, hereinafter: “Controller”).

    Personal data is processed in accordance with applicable law, including Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation) (hereinafter: “RODO”).

     

    VII. FINAL PROVISIONS

    The Organizer reserves the right to introduce changes to the list of rewards and the mechanisms for awarding points. Each amendment to the Terms and Conditions will be announced sufficiently in advance on the website www.batida.pl. or via the newsletter. Matters not regulated by these Terms and Conditions shall be governed by Polish law:

         the Act of 23 April 1964 – Civil Code;

         the Act of 16 February 2007 on competition and consumer protection;

         the Act of 23 September 2016 on out-of-court resolution of consumer disputes; and other legal acts referred to in these Terms and Conditions.
